Dallas Design Build, McKinney, TX; Case Number B–37980
Violation: Dallas Design Build practiced engineering without being registered with the Board and falsely sealed engineering documents indicating a professional engineer performed or directly supervised the work.
Act/Rule Violated: Tex. Occ. Code §§1001.405(b)(1)-(2), and 22 Tex. Admin. Code §§137.37(b) and 137.77(a) and (d).
Resolution: Cease & Desist Order and Administrative Penalty of $3,000.00.

Riddle Engineering Corp. #F-21066, Corpus Christi, TX; Case Number B–38277
Violation: Riddle Engineering Corp. offered and provided engineering services after Riddle Engineering Corp. had voluntarily surrendered its firm registration.  Riddle Engineering Corp. performed engineering services on eight (8) third-party mineral valuations during the period his firm was not registered.  Riddle Engineering Corp. subsequently re-registered its firm.
Act/Rule Violated: Tex. Occ. Code §1001.405(b)(1) and 22 Tex. Admin. Code §137.77(a), (d), and (e).  
Resolution: Administrative Penalty of $1,250.00.

 Mr. Juan Pablo Cantu, P.E. #90105, Los Fresnos, TX; Case Number D-37886
Violation: Mr. Cantu applied his seal and signature onto drawings he did not create.  Mr. Cantu failed to conduct engineering and related business in a manner that was respectful of the client and involved parties.
Act/Rule Violated: 22 Tex. Admin. Code §137.63(b)(5).
Resolution: One Year Probated Suspension contingent upon remittance of an Administrative Penalty of $1,885.00 and successful completion of Texas Tech University Engineering Ethics Basic Course.

Mr. Gerald Thomas Wynne, P.E. #94081, Sugar Land, TX; Case Number D-37911
Violation: Mr. Wynne performed engineering services in another jurisdiction while his license was expired in that jurisdiction.  Another jurisdiction issued Mr. Wynne a Cease and Desist Order for engaging in the unlicensed practice of engineering in that jurisdiction.   A third jurisdiction issued Mr. Wynne a Consent Order for practicing engineering while his license was expired in that jurisdiction.  Mr. Wynne failed to properly and promptly notify the Board he had been disciplined by the other jurisdictions' regulatory agencies.
Act/Rule Violated: 22 Tex. Admin. Code §137.5(c).
Resolution: Administrative Penalty of $450.00.

 Mr. John Ndunda Mutiso, P.E. #113701, Las Vegas, NV; Case Number D-38115
Violation: Mr. Mutiso was disciplined by another jurisdiction after producing an engineering report where he failed to practice engineering in a careful and diligent manner.  This disciplinary action was on a matter that would constitute a violation of the Texas Engineering Practice Act or board rules.
Act/Rule Violated: 22 Tex. Admin. Code §137.63(b)(6).
Resolution: One Year Probated Suspension.

 Mr. Daniel Jake Arredondo, P.E. #119989, Pflugerville, TX; Case Number D–38235
Violation: Mr. Arredondo misrepresented he completed 15 PDH of continuing education for the 2019 renewal period and in doing so, he did not engage in professional and business activities related to the practice of engineering in an honest and ethical manner.
Act/Rule Violated: 22 Tex. Admin. Code §§137.17(p)(3) and 137.63(a).
Resolution: One Year Probated Suspension contingent on remittance of an Administrative Penalty of $1,662.00 and successful completion of Texas Tech University Engineering Ethics Basic Course.

 Texas Star Surveying, Firm License #10137800, Houston, TX; Case Number D-38474/Complaint No. 18-02
Violation: Texas Star Surveying's employee signed, sealed, and issued a survey drawing with incorrect distances shown on the drawing, creating a misleading impression.  Texas Star Surveying's employee failed to do adequate research to find the recorded subdivision and failed to find and use the recorded subdivision when establishing the boundary of his signed and sealed survey.  Texas Star Surveying's employee failed to identify corners of record dignity and failed to indicate on his signed and sealed drawing how the monuments he set were marked in a way that is traceable to the responsible registrant or associated employer.  Texas Star Surveying's employee failed to indicate the firm's registration number on his drawing and failed to note upon the survey monuments of record dignity relied upon to establish the corners of the property surveyed.
Act/Rule Violated: 22 Tex. Admin. Code §§663.10, 663.16(3)(A), 663.16(3)(B), 663.16(3)(C), 663.17(d), 663.19(d), and 663.19(e).
Resolution: Administrative Penalty of $10,500.00.

 Mr. Stuart Allen Lynn, P.E. #96771, Bay City, TX; Case Number D-37856
Violation: Mr. Lynn jeopardized the health, safety, and welfare of the public by issuing misleading statements when Mr. Lynn falsely certified a project complied with the applicable windstorm building codes and was eligible for insurance coverage.
Act/Rule Violated: 22 Tex. Admin. Code §§137.55(b), 137.57(a)(3), and 137.63(a) and (b)(4)-(b)(6).  
Resolution: One Year Probated Suspension contingent on remittance of an Administrative Penalty of $2,423.00.

Mr. Eduardo Mojica Varias, P.E. #88236, Spring, TX; Case Number D-38000
Violation: Mr. Varias failed to practice engineering in a careful and diligent manner by relying on information from a contractor and failing to properly supervise the activities of a contractor.  Mr. Varias failed to engage in professional and business activities related to the practice of engineering in an honest and ethical manner by issuing an engineering letter that contained false information.
Act/Rule Violated: 22 Tex. Admin. Code §§137.55(b), 137.63(a), and 137.63(b)(6).
Resolution: Three Year Probated Suspension contingent upon remittance of an Administrative Penalty of $4,000.00 and successful completion of Texas Tech University Engineering Ethics Basic Course.
